Changes to HCBS Rule Quashed in House Energy and Commerce Committee
According to our sources at ANCOR, yesterday in the E&C Committee as part of the CHIP (children health insurance program) reauthorization markup, Rep. Bobby Rush had intended to submit an amendment but ended up pulling it. The amendment would prohibit CMS from keeping HCBS funding away from options that provided choice and were not nursing homes or hospitals (in other words it took presumably isolating settings like gated communities and farmsteads, etc. out of the rule's reach).
ANCOR was very involved in stopping the amendment from going forward - we opposed the amendment and don't believe the CHIP reauthorization is the right venue for such a major CMS rule to be impacted regardless of what it says.
